Clean Air Act and Smoke Control Area Requirements
Under the Clean Air Act, local authorities may designate all or part of their district as a
smoke control area. In these areas, it is an offence to emit smoke from the chimney of a
building, furnace, or 昀椀xed boiler, unless using an approved fuel or appliance.
Key Regulations for Smoke Control Areas
Emitting Smoke: In a designated smoke control area, it is an offence to emit smoke from
a chimney or appliance unless using an "exempt" appliance or an "authorised fuel."
Unauthorised Fuels: It is illegal to acquire "unauthorised fuel" for use within a smoke
control area unless it is burned in an appliance that is "exempt" from the usual
restrictions.
Exempt Appliances by Region
• England: Appliances are exempted by the Secretary of State and are published on an
approved list, as per changes made to sections 20 and 21 of the Clean Air Act 1993
by section 15 of the Deregulation Act 2015.
• Scotland: Exempt appliances are listed by the Scottish Ministers under section 50 of
the Regulatory Reform (Scotland) Act 2014.
• Northern Ireland: Exempt appliances are published by the Department of
Agriculture, Environment and Rural Affairs under Section 16 of the Environmental
Better Regulation Act (Northern Ireland) 2016.
• Wales: Exempt appliances are designated by Welsh Ministers through regulations.
